Photography & Videography Service Terms

These terms apply to all photography, videography, and visual content services provided by Garance Costard, photographer, filmmaker, and marketing specialist based in Vernon, British Columbia, Canada.
By booking services, the client agrees to the following terms.
1. Booking and Confirmation
A project is considered confirmed once a written agreement, confirmation, or signed proposal has been received.
Depending on the nature of the project, a deposit may be required to secure the booking date. Dates are not reserved until the booking has been confirmed.
2. Pricing and Payment
Prices are communicated through a quote, proposal, or written agreement.
Unless otherwise stated:

The remaining balance is due according to the payment terms outlined in the agreement
Any additional services, editing requests, or work not included in the original scope may result in additional fees.
3. Creative Approach
Garance Costard maintains full creative discretion regarding style, composition, editing, and final delivery of images or videos.
The client acknowledges that the final work reflects the artistic vision and professional judgment of the photographer and filmmaker.
4. Delivery of Content
Delivery timelines may vary depending on the project and will be communicated in advance.
Unless otherwise agreed:

Final images and videos are delivered digitally

Files are delivered in formats suitable for their intended use
Raw files (photos or video footage) are not included unless explicitly agreed upon in writing.
5. Video Revisions
Video editing includes a limited number of revisions, as defined in the project agreement or quote.
Unless otherwise specified, one round of revisions is included after the first delivery of the edited video.
Additional revisions, significant changes to the structure, storytelling, or editing style may result in additional fees.
Revision requests should be communicated within a reasonable timeframe after delivery.
6. Usage Rights
Garance Costard retains full copyright ownership of all photographs and video content created during the project.
Clients receive a usage license according to the terms defined in the agreement (for example: personal use, commercial use, or marketing use).
Content may not be sold, transferred, or distributed to third parties without prior written permission.
7. Portfolio and Promotional Use
Garance Costard reserves the right to use photographs and videos created during a project for:

website
-
social media
-
marketing and promotional purposes
Unless otherwise agreed in writing with the client.
8. Client Responsibilities
The client agrees to:

Provide accurate information about the project

Ensure access to agreed locations

Obtain any necessary permissions for filming or photography
The photographer or filmmaker cannot be held responsible for restrictions imposed by venues, authorities, or third parties.
9. Weather Conditions
For outdoor photography or video projects, weather conditions may affect the ability to capture the desired images or footage.
If weather conditions make the shoot unsafe or significantly impact the quality of the content, the photographer or filmmaker reserves the right to reschedule the session.
Rescheduling will be arranged with the client depending on availability.
10. Cancellation and Rescheduling
If a project must be cancelled or rescheduled, the client should notify as soon as possible.
Deposits may be non-refundable depending on the timing of cancellation and the time reserved for the project.

11. Credit and Attribution
When photographs or videos are published online or used for promotional purposes, credit to the creator is appreciated and encouraged whenever possible.
Examples of credit may include:

For editorial publications, media coverage, or public communication, proper credit should be provided when feasible.
12. Limitation of Liability
While all reasonable efforts are made to deliver the agreed services, Garance Costard shall not be held liable for circumstances beyond reasonable control, including but not limited to:

equipment failure

weather conditions

illness or unforeseen events

travel disruptions
In any case, liability is limited to the amount paid for the services.
13. Governing Law
These terms are governed by the laws of British Columbia, Canada.
Any disputes arising from these services shall be subject to the jurisdiction of the courts of British Columbia.
